Donna Summer‘s estate has sued Kanye West and Ty Dolla $ign for the unauthorized use of her 1977 song “I Feel Love” in their collaboration “Good (Don’t Die).”

The copyright infringement lawsuit was filed in federal court in Los Angeles by Summer’s husband Bruce Sudano in his capacity as executor of the estate of the singer-songwriter and “Queen of Disco,” who died in 2012.

According to court documents, Summer’s estate denied Ye’s request to sample the 1977 hit “I Feel Love.” It alleges that when his representatives sought permission for use of the song, they were rejected because the Summer estate “wanted no association with West’s controversial history.”

West has become a controversial figure in recent years, especially after he made comments that was heavily criticized as far right or anti-Semitic.

A sample of “I Feel Love” was used on his track “Good (Don’t Die).” The song appeared on Vultures 1, which dropped earlier this month, but has since been removed from streaming services.
